1. Introduction
Welcome to Musical Futures International. Account Termination

Termination by User:
You may cancel your subscription and delete your account at any time by contacting our customer support or via the “My Account” section on the website. Upon termination, your access to the platform will be revoked immediately.
Termination by Musical Futures International:
We reserve the right to suspend or terminate your account if you violate these Terms, engage in illegal activities, or fail to pay for your subscription. If we suspend or terminate your account for any reason, you will always be notified via email. The notification will include the reason for the action and, where applicable, the steps you may take to resolve the issue.
Effects of Termination:
Upon termination, you will lose access to all resources and content, and all rights granted to you under these Terms will cease. Any outstanding obligations under these Terms will remain enforceable.

User Responsibilities
By using the platform, you agree to:

Provide accurate and up-to-date information during registration and maintain the accuracy of your account details.
Keep your login credentials confidential and secure. You must notify us immediately if you suspect any unauthorised access to your account.
Use the platform content for educational purposes only. You may not sell, distribute, or exploit any platform content for commercial purposes.

3. Subscription Plans and Pricing:

Payment Methods and Billing

Payment Methods: Accepted payment methods include credit/debit card via our secure online checkout or online bank transfer by requesting an invoice for payment through school administration.
Payment Requirement: All subscription fees must be paid in full before access to any resources is granted.
Subscription Period: Subscriptions are billed annually for a fixed term of one year, commencing on the date payment is received and confirmed.
Renewal Process: We do not offer automatic renewal subscriptions. All renewals must be manually requested by the subscriber. Renewal reminders will be sent via email before your subscription expires, and you can renew via the "My Account" section or by contacting us directly.
Refund Policy: Subscription fees are non-refundable once access to resources has been granted, except where required under Australian Consumer Law or other applicable legislation.
Currency and Taxes: All prices are listed in [AUD] and include GST (if applicable).

4. Copyright Policy and Trademarks:

Copyright Ownership: All content on the platform, including educational resources, videos, and lesson plans, is owned by Musical Futures International Inc. and is protected by copyright law. Users may only access and use the content for personal, educational purposes.
Prohibited Use of Content: Users may not modify, redistribute, or sell the platform’s content. Unauthorised use of the content constitutes a violation of these Terms.
Trademark: "Musical Futures International" and associated device are registered under Australian Trade Mark Application No. 2501748. Users may not use the trademark without prior written consent from Musical Futures International.

5. Privacy and Data Protection

Data Collection: When you sign up for a subscription, we collect personal data, including your name, school name, school address, and contact phone number. This information is used to process transactions, send transactional emails, and provide updates on the platform.
Data Usage: Your data is used solely for platform-related communications, including renewal reminders, account notifications, and service updates.
Data Sharing: We do not share your personal data with any third parties.
User Rights: You can update your account information at any time by visiting the "My Account" section of the platform.

6. Uptime and Access Issues: While we aim to provide uninterrupted access to the platform, occasional downtime may occur due to maintenance, updates, or technical issues. We will notify users in advance if any extended downtime is expected. However, we do not guarantee continuous access to the platform, and any downtime will not be liable for damages.

Limitation of Liability: Musical Futures International is not responsible for any loss of data, service disruption, or other issues resulting from downtime. The platform is provided "as is," and we disclaim any liability for any damages arising from the use of or inability to use the platform.

7. Enforcement of Terms
If you violate these Terms, we may take the following actions:

Warning: A written warning will be issued via email, outlining the issue and any required actions.
Suspension: Your account may be temporarily suspended. You will be notified of the suspension via email, with instructions on how to restore access.
Termination: In cases of severe violations or illegal activities, we may permanently terminate your account. You will always be notified via email if your account is terminated.

8. Dispute ResolutionGoverning Law: These Terms shall be governed by the laws of the State of New South Wales, Australia.

Dispute Resolution Process: In the event of a dispute, we encourage you to contact us to attempt informal resolution. If the issue cannot be resolved informally, we will engage in mediation. If mediation fails, the dispute will be resolved through arbitration under New South Wales law. Any remaining issues will be addressed in the courts of New South Wales.

9. Changes to the Terms of Service: We reserve the right to update or modify these Terms at any time. Users will be notified of any changes via email. By continuing to use the platform after changes have been made, you agree to the updated Terms.

Current Version: This is the current version of the Terms of Service for Musical Futures International as of 05/12/2025. All previous versions are superseded by this one.
